Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and Dotzr, Inc. ("Dotzr," "we," "us," or "our") governing your access to and use of the Dotzr websites (including www.dotzr.com), mobile applications, services, tools, and features made available by us (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER SET FORTH BELOW. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICES.

1. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements and that you have the authority to enter into these Terms. The Services are intended for use by parents and legal guardians only, and not by children.

2. Account Registration and Security

To use certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep such information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or other breach of security. Dotzr is not liable for any loss or damage arising from your failure to safeguard your credentials.

3. Subscription Plans and Payments

Dotzr may offer free access, paid subscription tiers, and/or optional a la carte services. Subscription fees and billing terms will be disclosed at the time of purchase. All fees are stated in U.S. dollars and are non-refundable unless otherwise required by law.

Unless otherwise stated, subscriptions automatically renew at the end of each billing period. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle.

We reserve the right to change our pricing and subscription offerings at any time. We will notify you in advance of any material changes, and your continued use of the Services constitutes acceptance of those changes.

4. Use of Services

Subject to your compliance with these Terms, Dotzr grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial purposes in connection with managing family- and school-related information.

You agree not to:

Use the Services for any unlawful purpose or in violation of any applicable law;
Modify, copy, reverse engineer, or create derivative works from the Services or any related content;
Access or use another user's account without authorization;
Interfere with or disrupt the Services or any servers or networks connected to the Services;
Use automated systems (e.g., bots, scrapers) to access the Services without our prior written consent.

5. Linked Accounts and Third-Party Services

The Services may allow you to link third-party accounts (e.g., Gmail, Seesaw, Google Classroom, Evite, or school portals) to facilitate data import or integration. By linking such accounts, you authorize Dotzr to access and retrieve data from those services on your behalf and to use that data in accordance with our Privacy Policy.

Your interactions with any third-party platforms are governed by their own terms and policies. Dotzr is not responsible for the content or practices of such third-party services.

6. User Content

You may submit, upload, or transmit content to the Services, including but not limited to tasks, calendar entries, messages, and files ("User Content"). You retain ownership of your User Content, but by submitting it to Dotzr, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display such content solely in connection with providing and improving the Services.

You represent and warrant that you have all necessary rights to submit the User Content and that it does not infringe the rights of any third party or violate any law.

7. Communications and SMS Messaging

You may opt in to receive communications via email, SMS, or other channels. Dotzr may use such channels to send reminders, confirmations, updates, or other relevant information. By opting in, you consent to receiving such messages, including those sent using automated technology.

You may opt out of marketing communications at any time. To stop receiving SMS messages, you may reply STOP. You are responsible for any message and data charges that may apply.

8. Intellectual Property

The Services and all content, software, and other materials contained therein (excluding User Content) are the property of Dotzr or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted by these Terms, you may not use, reproduce, distribute, or create derivative works from any content made available through the Services without our prior written consent.

9. Termination

Dotzr may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if you violate these Terms. Upon termination, your license to use the Services will immediately cease, and we may delete any associated data, subject to our Privacy Policy.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. DOTZR DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not guarantee that the Services will be secure, error-free, or uninterrupted, or that any data provided through the Services will be accurate or reliable.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOTZR OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE TOTAL AMOUNT PAID BY YOU TO DOTZR IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold Dotzr, its officers, directors, employees, and affiliates harmless from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms or applicable law.

13. Dispute Resolution; Arbitration; Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Illinois, unless otherwise agreed by the parties.

YOU AND DOTZR WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. ANY CLAIM MUST BE BROUGHT INDIVIDUALLY.

You may opt out of arbitration within thirty (30) days of first using the Services by sending a written notice to info@dotzr.com.

14. Governing Law

These Terms shall be governed by the laws of the State of Illinois, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Cook County, Illinois.

15. General Provisions

These Terms constitute the entire agreement between you and Dotzr regarding the Services. If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect.

Dotzr's failure to enforce any provision shall not constitute a waiver of that provision or any other rights. You may not assign these Terms without our prior written consent.
